1. Identifying Data of the Service Provider

In compliance with the legal duty of information established in article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE), the identifying data of the person responsible for the web platform is provided below:

2. General Conditions of Access and Use

• 2.1. User Status: Access and navigation through the website copencils.com, as well as the use of its subdomains or authorized mobile applications, confers the status of User to anyone who performs it, implying full and unreserved acceptance of the provisions contained in this Legal Notice, in the Terms and Conditions and in the Privacy Policy.
• 2.2. Diligent and Lawful Use: The User undertakes to make appropriate, diligent, and lawful use of the functionalities of CoPencils, refraining from carrying out activities that could overload, damage, render useless, or undermine the integrity of the servers, databases, or networks linked to the owner of the service.

3. Intellectual and Industrial Property of the Platform and Brand

• 3.1. Ownership of Technological Assets: All constituent elements of the CoPencils Platform, explicitly including but not limited to: source code, software architecture, visual interface design (look & feel), graphic and typographic styles inspired by the Gutenberg press, style sheets, visual schemes, logos, trademarks, isotypes (including the intertwined pencils emblem in the shape of a "C"), and icons, are the exclusive property of Jaime Mateu Rico (Nodurix) or have been legitimately licensed by third parties.
• 3.2. Prohibition of Unauthorized Exploitation: Total or partial reproduction, decompilation, reverse engineering, distribution, transformation, or public communication of the technical infrastructure and design elements of CoPencils for commercial purposes other than those expressly provided for in the service is prohibited, unless prior and formal written authorization is granted by the Owner.
• 3.3. Literary Creations of the Users: The rights relating to specific literary contents and texts submitted and voted on by users are regulated in detail in Clause 4 of the Terms and Conditions of Contracting and Use.

4. Exemption of Liability for Third-Party Content (Art. 16 LSSI-CE)

• 4.1. Hosting Regime: In accordance with article 16 of Law 34/2002 (LSSI-CE), regarding the liability of intermediation service providers that host data provided by the recipients of the service, the Owner of CoPencils is not responsible for the information, manuscripts, literary fragments, comments, or opinions hosted at the request of users on the Platform, provided that:
  • It does not have actual knowledge that the activity or stored information is unlawful or that it infringes the property or rights of a third party liable for compensation, or
  • If it becomes aware of it, acts with due diligence to remove the data or make access to them impossible as soon as possible.
• 4.2. Determination of Actual Knowledge: It will be considered that the Provider has "actual knowledge" when a competent jurisdictional or administrative body has declared the unlawfulness of the content or the violation of intellectual property rights, ordered its removal or blocking, and the Provider has received the corresponding formal and reliable notification.
• 4.3. Notification Channel and Preventive Removal: Notwithstanding the foregoing, CoPencils provides authors and legitimate owners with direct community reporting channels and the email legal@nodurix.com to communicate alleged plagiarism or rights violations, proceeding to analysis and preventive removal in case of manifest infringement.

5. Outbound Links

In the event that CoPencils incorporates links to websites managed by third parties, the Owner declares that it exercises no control over such portals and declines any responsibility regarding their technical availability, veracity, lawfulness, or reliability. The establishment of these links does not imply a relationship of association, sponsorship, or commercial link between the Owner and the operators of the linked sites.

6. Legislation and Jurisdictional Forum

For the resolution of any discrepancy, litigation, or interpretative question derived from the access or use of this website, Spanish legislation will be exclusively applicable, with the parties submitting to the Courts and Tribunals of the city of Palma (Illes Balears), without prejudice to the legal jurisdictions that are mandatory in matters of consumers and users.

7. Payment, Subscription, and Refund Policy

7.1. Payment Processing (Merchant of Record)

CoPencils' subscription and payment services are securely operated and processed through our authorized provider and Merchant of Record (MoR), Paddle.com Market Limited (and its affiliated entities). When making a purchase or subscribing to CoPencils, the User is making a transaction directly with Paddle, subject to Paddle's Terms of Service and Privacy Policy.

7.2. Cancellation Policy

The User may cancel their subscription at any time through the control panel of their CoPencils account. The cancellation will take effect at the end of the current billing cycle (monthly or annual). The User will retain full access to the paid features until the expiration date of the paid cycle. No additional charges will be made after cancellation.

7.3. Refund Policy (14-day Guarantee)

To guarantee complete satisfaction, CoPencils offers a full refund policy ("Money-back Guarantee") during the first 14 calendar days following the first purchase or initial subscription. If the User is not satisfied with the service, they can request a full refund of the amount by writing an email to legal@nodurix.com within this period, without the need for justification.

7.4. Refund Exceptions

After the initial 14 days from the contract, processed payments are final and non-refundable. Refunds do not apply to automatic renewal charges for recurring subscriptions, unless a demonstrable technical error on the part of the Platform prevented prior cancellation by the User.
